Terms of Service & End User License Agreement

Welcome to Beer Me. These Terms of Service and End User License Agreement (the "Terms") are a binding agreement between you and DMCStack Pty Ltd ("we", "us", "our") governing your use of the Beer Me mobile applications and website (the "Service"). By creating an account, logging in, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years of age to use Beer Me. The Service relates to alcohol and is intended for adults of legal drinking age in your jurisdiction.

2. Your Account

You are responsible for the activity that occurs under your account and for keeping your login credentials secure. You agree to provide accurate information and to keep it up to date.

3. User-Generated Content & Community Conduct

Beer Me lets users post content such as reviews, ratings and comments ("User Content"). You are solely responsible for the User Content you submit.

There is zero tolerance for objectionable content or abusive behaviour. By using the Service you agree that you will NOT post, upload, or transmit any User Content that:

  • is abusive, harassing, threatening, hateful, defamatory, obscene, or sexually explicit;
  • contains slurs or attacks based on race, ethnicity, nationality, religion, gender, sexual orientation, disability, or any other protected characteristic;
  • is unlawful, fraudulent, or promotes illegal activity or harm to others;
  • infringes the intellectual property or privacy rights of any person; or
  • is spam, or otherwise objectionable.

We reserve the right, but are not obligated, to review, filter, refuse, or remove any User Content at our sole discretion. We have no tolerance for objectionable content or abusive users. Content reported as objectionable is removed from public view pending review, and we act on reports of objectionable content within 24 hours by removing the content and ejecting the user who provided it.

4. Reporting and Blocking

The Service provides tools to report objectionable content and to block abusive users. Blocking a user immediately removes their content from your view. Abuse of the reporting or blocking tools (for example, filing false or excessive reports) may itself result in restrictions on your account.

5. Enforcement

If you violate these Terms, we may, without notice, remove your content, suspend your ability to post, or permanently terminate your account. Automated systems may temporarily suspend posting privileges where objectionable content is detected, with escalating durations for repeat offences.

6. Licence

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial use.

7. Pricing & Menu Information

Beer Me is a community, crowdsourced service. All prices, serving sizes, happy-hour times, and menu details on the Service are submitted by users and other third-party sources — not by us and not by the venues — so their accuracy cannot be guaranteed and they may be inaccurate, incomplete, out of date, or wrong.

You acknowledge and agree that:

  • We do not set, control, verify, or guarantee any price. Prices are indicative only and are provided for general information.
  • The only authoritative price is the price the venue actually charges you at the point of sale. Prices change frequently and without notice, and may vary by serving size, membership, promotion, day, or time.
  • Prices shown are not an offer, quote, or contract and create no obligation on us or any venue to sell at a displayed price.
  • We are not affiliated with, endorsed by, sponsored by, or an agent of any venue whose prices or details appear on the Service, unless expressly stated.
  • You rely on any price or menu information at your own risk and should confirm the current price with the venue before making a purchase or travelling to a venue.

We may, but are not obliged to, correct or remove information reported as inaccurate. If you spot an incorrect price, please report it in-app so the community can keep data accurate.

8. Automated Access, Scraping & Data Protection

The venue, product and pricing directory in this app (including community-contributed prices, menus, venue details and imagery) is a database compiled, verified and maintained by DMC Stack Pty Ltd. We claim all available rights in that compilation.

Except as expressly permitted in writing by DMC Stack Pty Ltd, you must not:

  • access the Service by any automated means (including bots, scrapers, crawlers, headless browsers or scripts) other than search engines complying with our robots directives;
  • extract, harvest, copy, mirror or bulk-download any part of the directory, pricing data, menus or images, whether manually or by automated means;
  • use any content from the Service to train, fine-tune or evaluate machine-learning or AI models;
  • republish, resell, sublicense or make directory or pricing data available to any third party or competing service; or
  • circumvent, probe or overload any rate limits, authentication or other technical protections.

We may throttle, block, suspend or terminate access (including by IP, device or account), and pursue any other available remedy, where we reasonably believe this section has been breached. Sections of this clause survive termination of your account.

9. Disclaimers & Liability

The Service — including all pricing, menu, and venue information — is provided "as is" and "as available" without warranties of any kind, express or implied, including as to accuracy, reliability, completeness, or fitness for a particular purpose. To the maximum extent permitted by law, we are not liable for any loss or damage (including any indirect, incidental, or consequential loss, wasted expenditure, or loss arising from reliance on pricing or menu information) arising from your use of, or inability to use, the Service.

Australian Consumer Law: Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law or other law that cannot lawfully be excluded. Where our liability cannot be excluded but can be limited, our liability is limited to the resupply of the Service (or the cost of resupply).

10. Changes

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
